Website terms
These cover using this website and reading what is published on it. They are not the agreement for building your site — that is a separate document you would read and accept before paying anything.
1. Who you are dealing with
This site is operated by Berke Emrecan Arslan, an individual sole trader trading as Artemian (ABN 92 355 684 231), based in Subiaco, Western Australia. "We" and "us" mean that business. "You" means whoever is using this site. Contact us at hello@artemian.com.au.
2. This site is information, not an offer
Everything published here — the package, the inclusions, the exclusions, the timing targets, the prices — describes our standard service so you can decide whether to enquire. None of it is a contractual offer, and nothing on this site creates an agreement between us.
An agreement only exists once we have sent you a written scope, you have accepted it in writing, and the commencement payment has been made. Until all three have happened, neither of us owes the other anything.
3. Sending a fit check does not book you anything
Submitting the fit-check form is an enquiry. It does not create a contract, does not reserve a build slot, does not lock in a price, and does not oblige us to take the work. We may reply that the job does not suit this package, and we may decline work without giving a reason.
We ask you not to send sensitive information through that form. What we do with what you send is set out in ourprivacy notice.
4. Published prices
The A$2,200 build price and the A$129 monthly care price apply to work that fits the package described on this site. Anything outside it gets a written price you approve before we start. Prices are in Australian dollars.
Not registered for GST; no GST is charged.
We can change published prices at any time. A change does not affect a scope you have already accepted, and it does not apply retrospectively to work already agreed.
5. What we do not promise
We build websites. We do not sell traffic, rankings, or customers, and we do not promise any of them. Nothing on this site is a representation that your site will reach a particular position in search results, attract a particular amount of traffic, generate a particular number of enquiries, or produce any level of revenue.
Whether your phone rings depends on your pricing, your reputation, your competition, your area, and how people find you — none of which we control. Timing figures on this site are targets we aim at, not guarantees, and they assume you get back to us promptly and third parties behave.
6. Your consumer rights are not affected
Nothing on this site or in our agreements excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, we do so in the agreement you sign — and you get to read that before you pay anything.
Otherwise, this site is provided as it is. We aim to keep it accurate and available, but we do not warrant that it will be uninterrupted, error-free, or current at every moment.
7. What is ours, and what you may do with it
The content, layout, code, and design of this site belong to us or our licensors. You are welcome to read it, print it, share a link to it, and quote it fairly with attribution.
You may not copy this site's design or copy for a competing service, scrape it in bulk, resell it, or present it as your own. What a client owns once we build their site is a different question, answered on theservices page and settled properly in the agreement.
8. Links to other sites
Where we link to someone else, we are pointing at something useful, not vouching for it. We do not control those sites and are not responsible for their content, their accuracy, or how they handle your information.
9. Using this site sensibly
Do not attempt to break into, overload, disrupt, or probe this site or the systems behind it. Do not submit anything unlawful, deliberately false, or belonging to someone else without their permission. Do not use the form to send advertising. We may block access where any of that happens.
10. If the site and the agreement disagree
This site describes the standard package in plain English so you can make a decision. The agreement you sign before paying is what actually governs the work. If the two ever say different things, the agreement wins — and if you spot a contradiction, tell us, because one of them needs fixing.
11. Changes to these terms
We may update these terms. The current version is always the one on this page, with the date at the top. Using the site after a change means you accept the updated version.
12. Governing law
These terms are governed by the laws of Western Australia, Australia. Disputes go to the courts of Western Australia, though we would much rather you emailed us first — most things sort out in one message.
